Terms and Conditions

Definitions

1.1 ‘Buyer’ means the group or individual who agrees to purchase goods from the seller

1.2 ‘Contract’ means the agreement between the Seller and the Buyer for the purchase of goods under the conditions outlaid by these Terms and Conditions

1.3 ‘Goods’ equates to the products that the Buyer agrees to purchase from the seller

1.4 ‘Seller’ means Katy Ray of 369 Westhorne Avenue, Lee London, SE12 9AB, who owns and operateswww.katyray.co.uk

1.5 ‘Terms and Conditions’ means the terms and conditions of sale set out in this agreement. Any other agreements must be confirmed in writing

1.6 ‘Website’ meanswww.katyray.co.uk

Conditons

2.1 The Buyer’s statutory rights are not affected by the Terms and Conditions set out in this agreement

2.2 These Terms and Conditions apply to all contracts of sale between the Buyer and Seller

2.3 Acceptance and delivery of the Goods shall be deemed conclusive evidence of the Buyer’s acceptance of these Terms and Conditions

2.4 Any complaints should be address to the Seller’s address as stated in clause 1.4

Ordering

3.1 All orders for goods shall be deemed an offer by the Buyer to purchase goods in agreement to the Terms and COnditoins stated on this page. It is within the Sellers right to not accept the order for any reason.

3.2 where goods are ordered by the Buyer, and not in stock the Buyer shall be notified and given the option for either to wait until the Goods are available in stock or cancel the order and full refund within 30days.

Price and Payment

4.1 All prices on the website are in pounds sterling and are correct as of 1^stMay 2010. The price shown next to the product is inclusive of VAT, but not delivery charges.

4.2 The final price quoted on the payment page of the website is the price that will be debited from your account and includes the delivery charge

4.3 Afer the order is received the Seller shall confirm the details by email, including information of description, delivery address and price.

4.4 Payment will be debited from your account before the delivery is dispatched. The utmost care will be taken to keep the details of your order secure.

Rights of Seller

5.1 The seller reserves the right to change and update prices on the Website. The Seller shall make every effort to make sure the prices are correct at the point the Buyer makes an order

5.2 The Seller reserves the right to remove products form the Website at any time,

5.3 The Seller shall not be liable to anyone for withdrawing goods from the Website or for refusing to process an order

Delivery

6.1 We aim to deliver Goods with the UK within 5 working days of receiving your order.

6.2 The Seller shall use reasonable endevours to meet any date agreed for delivery. In any event concerning the time of delivery, the Seller shall not be liable for losses, costs, damages or any expenses that are incurred by the buyer arising from the Seller failing to meet the estimated delivery date.

6.3 The ‘Goods’ remain that of the Seller until the total

price has been paid in full

6.4 Delivery of the Goods shall be made to the Buyer’s address as specified on the order

6.5 In the case of non- delivery, the Buyer should wait 10 days before contacting Katy Ray from the date of delivery in case it has been delayed.

Cancellations and Returns

7.1 The Buyer may cancel the order for any reason up the point of dispatch and any payments made shall be refunded within 28 days

7.2 The Buyer is entitled to to notify the Seller at … within 7 days of delivery if the goods are damaged. IF the Buyer fails to do so the Buyer shall be deemed to have accepted the goods

7.3 Where a claim of damage or defect is made, the Goods shall be returned from the Buyer to the Seller within 28days.The Buyer shall be entitled to a replacement or a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective.

7.4 The Consumer also has the right to cancel the contract and receive a refund within 7 working days in receipt of the goods. All items must be returned via registered post with proof of postage required. In this event a full refund of the product purchased with be made within 30days of receiving the returned goods. Please note, refunds will be made using the same method as the original payment. The customer is responsible for paying for the postage of the returned goods. Items must be returned to the contact address sited in clause 1.4. The right to cancel does not cover bespoke items.

7.5 Goods to be returned must be clearly show the order number obtained from the Seller on the package

7.6 When returning Goods, the buyer should obtain proof of posting, or shipping certificate from the courier. Goods which are returned to but are lost in shipping remain the Buyer’s responsibility.

7.6 Where returned Goods are found to be damaged due to the Buyer‘s fault the Buyer will be liable for the cost of remedying such damage.

Trade description Act

8.1 All dimensions are approximate and although every care has been taken to ensure that the colours are reproduced accurately, as most of the items are natural materials, hand-printed and handmade, shading and dimensions may vary slightly from the product pictured.

Security

9.1 The ‘Seller’ shall take all the necessary precautions to keep the sensitive information supplied to us by our customers confidential. We, the ‘Seller’, shall not pass on any information onto third parties, but may use information such as email addresses for the sole use of promoting Katy Ray. The information provided to us may be stored on a secure computer system, but will not be passed on in anyway.
